Sued Maryland, Prince George's County and Montgomery County on Oct. 1, 2026, arguing their new laws requiring on-duty federal officers, including ICE agents, to show identification and go unmasked violate the Supremacy Clause. Assistant Attorney General Brett Shumate said, "The Federal Government, not state and local governments, gets to decide which equipment federal officers may or may not wear when performing their official duties." The department said Maryland was the eighth state it has sued over such laws. Gov. Wes Moore's office said the governor "has been clear that an untrained, unqualified, and unaccountable ICE is unacceptable."
